Terms & Conditions for Export
1. Introduction
Welcome to askbasket™. These Terms & Conditions govern the export of our products, including but not limited to organic teas, to international customers. By placing an export order with askbasket™, you acknowledge and agree to comply with these Terms & Conditions. Please read them carefully.
2. Eligibility
- Only verified businesses, wholesalers, stockists, distributors, or authorized buyers are eligible for bulk or export purchases.
- Buyers must comply with all legal and regulatory requirements of their respective countries.
3. Products & Quality Assurance
- askbasket™ ensures that all teas are produced through organic and sustainable processes, meeting Indian and international quality standards.
- Certificates such as FSSAI, USDA Organic, EU Organic, Fair Trade, or other relevant certifications will be provided upon request, subject to availability.
- Product specifications, packaging details, and shelf life will be shared before order confirmation.
4. Orders & Minimum Order Quantity (MOQ)
- Orders are accepted based on product availability and agreed quantities.
- Minimum Order Quantities vary by product category and will be communicated prior to confirmation.
- Custom packaging, labeling, and private branding services may be provided at additional costs.
5. Pricing & Payment Terms
- All prices are quoted in USD, EUR, or INR, unless otherwise agreed.
- Payment terms may include Advance Payment, Letter of Credit (LC), Bank Transfer (SWIFT/TT), or Escrow Services for high-value orders.
- Partial advance payments may be required for order processing.
- Any bank charges, forex fees, or transaction costs are to be borne by the buyer.
6. Shipping & Incoterms
- Exports are executed under internationally recognized Incoterms 2020, such as FOB (Free on Board), CIF (Cost, Insurance & Freight), DDP (Delivered Duty Paid), or EXW (Ex-Works) as mutually agreed.
- Shipping timelines vary depending on destination, order size, and mode of transport (air, sea, or courier).
- Buyers are responsible for import duties, customs clearance, and local taxes unless agreed otherwise.
7. Insurance & Risk
- askbasket™ strongly recommends insurance coverage. Options include:
- Marine Cargo Insurance
- Export Credit Insurance
- Product Liability Insurance
- Political Risk Insurance
- Risk and ownership transfer to the buyer once goods are handed over to the carrier or as per agreed Incoterms.
8. Documentation
For every export shipment,askbasket™ will provide:
- Commercial Invoice
- Packing List
- Certificate of Origin
- Bill of Lading/Airway Bill
- Phytosanitary Certificate (if required)
- Insurance Certificate (if applicable)
- Organic and Quality Certifications (if applicable)
9. Cancellations & Refunds
- Orders once confirmed cannot be canceled without written approval.
- Refunds or replacements will only be considered in cases of verified transit damage or product quality issues.
- Claims must be reported within 5 working days of delivery with photographic/ video evidence.
10. Compliance
- Buyers are responsible for ensuring that the imported products comply with their country’s import laws, safety standards, and food regulations.
- askbasket™ will not be liable for any restrictions, confiscations, or penalties at the buyer’s destination.
11. Intellectual Property
- All brand names, trademarks, packaging designs, and content belong to askbasket™.
- Unauthorized use, replication, or distribution of our brand assets is prohibited.
12. Governing Law & Jurisdiction
- These Terms & Conditions shall be governed by the laws of India.
- Any disputes shall be subject to the exclusive jurisdiction of the courts at Pathsala/ Guwahati, India.
